Prices

The prices of all products shown on the website are inclusive of VAT.

The price to be paid by you is that displayed on the site at the time when your order is received by us. In the event that we discover a genuine error in the price for the goods ordered by you as displayed on the site, we shall notify you as soon as possible providing you the option of either reconfirming the order at the correct price or cancelling the order. If we are unable to contact you for the purposes within 10 working days or if you fail to either reconfirm or cancel the order within this period, your order will be cancelled and any payment will be refunded in full.

Prices given to customers in communications including quotations – The price to be paid by you is as stated. In the event that we discover a genuine error in the agreed price for the goods or services ordered by you, we shall notify you as soon as possible providing you the option of either reconfirming the order at the correct price or cancelling the order. Guarantee

Your goods are guaranteed for a 1 year period from the date of delivery against faulty manufacture.

Returns, Refunds & Exchanges

Returning your product because it’s unwanted:

You must notify us in writing within 14 days of receipt of your order if you want to cancel and return the whole or part of an order.

For returns of complete orders we will refund the full purchase price that you originally paid plus the cost of postage of standard delivery, within 14 days of us receiving your entire order back.  If you are returning part of an order, we will refund the purchase price of the item you are returning but not any postage.

We reserve the right to charge a restocking charge and to charge for any goods not returned in saleable condition or exceeding the 14 day notification period. Please notify us before returning goods.

It is your responsibility to cover the cost of returning the goods and to insure them for their value in case they should go astray or be damaged in transit. 

Return your item unused and in its original condition (see below), enclosing details of yourself and the order and we will give you an exchange or refund.

Some products cannot be returned unless faulty or not as described – see below.

Ordinarily we’ll refund the original debit, credit or charge card used for the purchase.

Please note that if you return products which are outside our returns policy we’re unable to process a full refund.  

Original condition is defined as

  • you’ve kept all original packaging and labels in good condition and the product can be resold at full price 

  • you haven’t used the product

  • the product contains no personal data and isn’t registered to a user. 

The following products are not eligible for exchange or refund (unless faulty or not as described):

  • Products which you have not notified us about returning more than 14 days after receipt

  • Products that have been unsealed (other than to inspect)

  • Products without original packaging or where it’s been returned in poor condition

  • Products that contain your personal data or have been manufacturer-registered

  • Where a product has been personalised for you, or made to your specific measurements – This includes Earth Sheets, Recovery Cocoons and the 3 Bed Sheet System

  • Products which have been opened or their protective seals removed or have been in contact with the skin (unless faulty):

    • ALL Clothing

    • Earth Sheets

    • Recovery Cocoon

    • 3 Bed Sheet System

Returning your product because it has a fault:

If your product develops a fault within 30 days of purchase, please return with proof of purchase and we will repair, exchange or refund it.  Please notify us immediately of any such problems and we will discuss the methods of returning goods. If we are not notified, we regret that we are unable to accept any responsibility for the cost of the return or any losses incurred should the return fail to reach us.

After 30 days (but less than  one year) we’ll repair or replace the product in accordance with the terms of the Consumer Rights Act 2015.

It is your responsibility to take “reasonable care” of the goods. After 30 days we will need the product to be returned for inspection. We can then discuss either repairing or replacing the item. It is the customer’s responsibility to cover the cost of returning the goods and to insure them to cover the value of the item/s should they go astray or be damaged in transit.

If you’ve changed your mind about keeping your purchase, please return it in its original condition and we’ll exchange or refund it.

Please note that if you return products which are outside our returns policy, we’re unable to process a full refund.  

None of the above affects your statutory rights.

VAT On Products for People with Disabilities

We have been asked a few times if we can sell products without VAT to people who have disabilities or a severe allergy to EMFs.  We have checked with HMRC and were told that this is not possible.  They said:  “VAT notice 701/7 explains the type of goods which are eligible for VAT relief for disabled people or those with a chronic illness. Reliefs from VAT for disabled and older people (VAT Notice 701/7) – GOV.UK (www.gov.uk)  Unfortunately, the items you have mentioned aren’t included in the list of eligible goods in Section 4 of the above VAT notice.

I can confirm that VAT is a self-assessed tax and only the designer or manufacturer can determine whether goods qualify for zero-rating. They can zero rate the supply to an eligible customer of equipment and appliances that have been ‘designed solely for use by disabled people’. This means the original intention of the designer was to produce equipment or an appliance designed solely to meet the needs of disabled people.

It is not sufficient for zero-rating that the equipment or appliance is intended for use by a disabled person, or is mainly purchased by disabled persons. Equipment which meets the needs of people with such a condition will only qualify for zero-rating if designed solely for the purpose of meeting the needs of disabled sufferers of the condition.

I have looked at your website and, as electro-sensitivity isn’t recognised in the UK as a medical diagnosis, the goods you are selling cannot be classed as ‘designed solely’ for use by a person with a disability or a chronic illness.  Therefore, these goods won’t be eligible for VAT relief and VAT should be charged at standard rate.”

We are aware that some of our competitors are doing this and we would kindly suggest they urgently seek guidance from HMRC.

Consumer Contracts Regulations 2013

This legislation offers you the following cancellation rights when you buy online or by phone:

  • You are entitled to cancel your contract if you so wish, provided that you exercise your right no longer than 14 days after the day on which you receive the goods or services

  • Your right to return products does not apply to goods made to your specification, that have been clearly personalised or which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly

  • If you wish to exercise your right of cancellation, you are obliged to retain possession of the goods and take reasonable care of them

  • To exercise the right to cancel, you must inform us of your decision to cancel your contract by a clear statement, including details of your name, geographical address, details of the order you wish to cancel and, where available, your phone number and email address

  • If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. This includes the cost of delivery (except for the supplementary costs arising if you choose a type of delivery other than our standard and least expensive method of delivery)

  • We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

Changes to Product Specifications and Product Unavailability

We describe our products as accurately as we can. Any error or omission in any information on the site or document issued by us shall be corrected provided that the correction does not materially affect the Contract of Sale. We or our suppliers may, from time to time and without notice, change the Goods in order to comply with any applicable statutory requirements provided that such changes do not materially affect the nature or the Price of the Goods.

If the products ordered by you are not available, we will contact you and offer you the option of either ordering alternative Goods or cancelling your order. If we are unable to contact you within 28 Working Days the Contract will be deemed cancelled and any sums you have already paid to us in respect of the Goods ordered will be refunded in full.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied by statute, custom or usage relating to the information contained in this Website and we shall not be liable for any losses or damages whatsoever, whether in contract, tort (including negligence), or otherwise arising from this website, or from any interruption or delay in accessing this Website.

Any references on this website or contained in any consultations (including telephone, Skype & Zoom) to any specific products, processes, or services by trade name, trademark, manufacturer, or otherwise, does not constitute or imply its endorsement, recommendation, or favouring by Beneficial Environments.  No liability is therefore accepted by Beneficial Environments for any claims relating to endorsement, recommendation, or favouring products, processes or services.  This does not affect your statutory rights relating to purchases and covered by the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015.
